PRIVACY POLICY
ARTICLE 1. PREAMBLE
The sole proprietorship managed by Mr Romain CAZAUX-LEROU, located at 22 rue Georges Brassens 31320 CASTANET-TOLOSAN (hereinafter referred to as the “Site Publisher”) is, in its capacity as personal data controller, strongly committed to the protection and respect of privacy.
For this reason, only the personal data strictly necessary for the processing of the present Site is processed, and only with the consent of the User (i.e. the visitor and/or the person using the Site’s “Services”), when such consent is required by the law and regulations in force.
The “Services” are understood to be the products and/or services offered and/or sold by the Site Editor.
This Privacy Policy applies to the processing of personal data (“Data”) collected on the www.pause-stat.pro website (“Site”).
The Site is hosted by Planet Hoster, headquartered at 4416 Louis B. Mayer, Laval (Quebec) H7P 0G1, Canada.
The host can be contacted here: 0 805 080 426.
The hosting servers on which data is processed and stored are located exclusively in France and Switzerland.
The purpose of this privacy policy is to inform the User of the manner in which the Site Editor collects and processes his personal data.
ARTICLE 2. APPLICABLE REGULATIONS
French and European legislation and regulations in force relating to the protection of personal data must be complied with by the Website Editor: in particular the General Data Protection Regulation (RGPD) n°2016/679 of April 27, 2016 and national provisions relating to information technology, files and freedoms, including Law N°78-17 of January 6, 1978 in its amended versions.
ARTICLE 3. DEFINITION AND COLLECTION OF PERSONAL DATA
Personal data (hereinafter referred to as “Personal Data”) is any information relating to an identified or identifiable natural person (hereinafter referred to as the “Data Subject”).
An “identifiable natural person” is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.
The Personal Data of persons who connect to the Site are collected by the Site Editor.
The data likely to be collected are the following (without being exhaustive):
- Name or company name of the organization you represent
- Civility
- Last name
- First name
- E-mail address
- Telephone number
- Postal address (address, zip code, town)
- Reason(s) for contact
- Login data (username/password encrypted)
- Browsing data and IP address
ARTICLE 4. DEFINITION AND PURPOSES OF PROCESSING
Processing” is any operation or set of operations, whether or not carried out using automated processes and applied to personal data or sets of data, such as collection, recording, organization, structuring, conservation, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, reconciliation or interconnection, limitation, deletion or destruction.
Any person wishing to access the Site and Services expressly consents to the processing of his or her Personal Data.
The data collected is processed for the following purposes:
- Access to the Site
- Receiving and sending messages by e-mail and/or post
- Improving the Site and the user experience
- Preventing, detecting and investigating any potentially fraudulent activities (hacking, spamming, etc.)
- Managing the exercise of the User’s rights and personal data.
Personal Data may also be collected to comply with cases provided for by regulations, in particular:
- Safeguarding the vital interests of the Data Subject or of another natural person;
- Performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
- Legitimate interests pursued by the Data Controller or by a third party, unless the interests or fundamental rights and freedoms of the Data Subject that require protection of Personal Data prevail.
Any use of Personal Data for purposes other than those set out herein will require the express prior consent of the person concerned.
In any event, the Site Editor undertakes not to use the Personal Data of its Users for purposes other than those necessary for the operation of the Site and the performance of its Services.
ARTICLE 5. RECIPIENTS AND SHARING OF PERSONAL DATA
The Site Publisher may transfer and disclose the Personal Data of Data Subjects to:
- employees or service providers of the Site Editor ;
- partners, professionals and/or subcontractors for commercial, technical or logistical reasons (Site hosting and maintenance service providers, database management service providers, CRM tool);
- co-controllers, whose identity is indicated prior to each processing operation;
- any supervisory authority, such as the Commission Nationale de l’Informatique et des Libertés (CNIL);
- any person concerned in the event of a dispute (lawyer, court commissioner, etc.);
- at the request of any judicial or administrative authority (notably in the context of the fight against money laundering or the fight against the financing of terrorism).
The User acknowledges that the Site Editor has no control over the transfer of Personal Data via the public telecommunication networks used by the User to access the Services, and in particular the Internet network. The User acknowledges and accepts that the Site Editor cannot guarantee the confidentiality of Personal Data when transferred over such public networks. Consequently, the Site Editor cannot be held liable in the event of the misappropriation, capture or corruption of Personal Data, or any other event likely to affect such data, occurring during its transfer to public telecommunication networks.
ARTICLE 6. DATA STORAGE
The Site Editor hereby undertakes to implement and enforce the security measures that the Site Editor deems necessary to ensure the protection and confidentiality of Personal Data collected on the Site for the duration of their processing.
The Personal Data collected is kept securely for the entire duration of the relationship between the User and the Site Editor, and in any event for as long as is strictly necessary for the purposes indicated above, and within the limits imposed by applicable laws and regulations.
For his part, the User undertakes to protect his Personal Data by complying with good practice in the use of IT tools (non-disclosure of data, disconnection on public computers, use of antivirus software, etc.).
As an indication, Personal Data is kept for a period of three (3) years from the end of the contractual relationship or the last incoming contact with a User.
At the end of this period, all Personal Data enabling the User to be identified will be deleted and destroyed, with the exception of those whose retention by the Site Publisher is necessary to enable it to meet its legal obligations.
ARTICLE 7. USER RIGHTS
By virtue of the legal provisions and regulations in force, any Person Concerned by a processing operation has the following rights in respect of his or her Personal Data processed:
a) the right to obtain information about the Personal Data held about them by the Site Publisher and the processing carried out;
b) the right to complete, modify or correct Personal Data;
c) the right to request the deletion of Personal Data (the right to be forgotten or erased), subject to any legal or regulatory provisions that may require the Site Publisher to retain them;
d) the right to ask the Web Site publisher to restrict, or the right to object to, the processing of your Personal Data, in certain circumstances (for example, when you dispute the accuracy of your Personal Data, when you consider that their processing is unlawful, or when it is necessary for the challenge, exercise or defense of your legal rights);
e) the right to request the portability of Personal Data, and in particular the transfer of Personal Data to another data controller in a structured, commonly used and readable format, within the limits provided for by the regulations;

Pour l’exercice de ses droits, la Personne Concernée peut adresser un courrier à l’Editeur du Site, avec un justificatif d’identité ainsi que toute information complémentaire pouvant être utile au traitement de sa demande. Ce courrier doit être envoyé :

En outre, l’Editeur du Site est susceptible de vérifier l’identité et/ou de demander à la Personne Concernée de lui fournir davantage d’informations pour pouvoir répondre à sa demande.
Elle s’efforcera de donner suite à la demande dans un délai raisonnable et, en tout état de cause, un délai de deux (2) mois à compter de la réception de la demande. Au besoin, ce délai pourra être prolongé, compte tenu de la complexité et du nombre de demandes adressées. Dans ce cas, l’Utilisateur sera informé de cette prolongation et des motifs du report.
ARTICLE 8. COMMERCIAL PROSPECTING
In any event, the Site Publisher may send you commercial solicitations (promotional offers, newsletters, etc.) as well as messages relating to the operation or administration of the Services.
If the User subscribes to the Site Editor’s offers and news, information on these offers will be regularly communicated. The only information required to send them is the User’s e-mail address. The provision of any other data is optional and may only be used to contact the User personally.
The User will only receive such offers by e-mail if he/she has expressly consented to them being sent. Once consent has been received, a confirmation e-mail will be sent asking the User to confirm his or her wish to receive future offers, and the User need only click on the confirmation link to definitively validate his or her subscription to these offers.
The User may unsubscribe at any time via the link provided, or by sending a message to the following e-mail address: romain@pause-stat.pro.
Once unsubscribed, the User’s e-mail address will be immediately deleted from the mailing lists.
ARTICLE 9. BANKING DATA
Payment for transactions concluded on the Site is processed by the service provider Stripe Payments Europe, whose registered office is at 10 Boulevard Haussmann, 75009 Paris, France (www.stripe.com, 0 805 11 19 67).Online payment assumes that the User holds a means of payment issued by a banking institution and usable at merchants and service providers.
When making an online payment, the User/buyer consents to his/her data being passed on to Stripe Payments Europe, which may carry out an identity and credit check on the basis of the data provided by the purchaser (name, address, account number, bank code, credit card number, cryptogram, invoice amount, etc.).If the data is not provided, it may be impossible to conclude or execute the contract.
To improve the purchasing experience, the Site Editor offers the User the option of memorizing his/her bank details so that he/she does not have to enter them each time he/she places a new order.The visual cryptogram on the back of the credit card is never memorized by the Site Editor.Further information on Stripe Payments Europe’s privacy policy is available at www.stripe.com/fr/privacy.
ARTICLE 10. COOKIES POLICY
When browsing or using the Site, the User accepts that the Site Editor may store and access cookies and other tracers as set out below.
Definition of a cookie
A cookie is a text file that may be stored in a dedicated space on the hard disk of your terminal (computer, smartphone, tablet) when you consult an online Service using the User’s browser software.
Cookies can be used to help navigate from page to page, to adapt the content of the Site’s Services or to memorize the User’s browsing preferences.
Cookies are managed by the Internet browser.They do not recognize the User personally and do not store any sensitive personal data about the User, but only recognize the device the User is using.

Lifetime of cookies on the Site
The retention period for cookies placed on the Site varies according to their type. With the exception of technical cookies, for which the User’s consent is not required, other types of cookies have a limited lifetime of thirteen (13) months.
User’s choice concerning Site cookies
By using the Site, the User consents to the use of cookies. This Privacy Policy may be modified, supplemented or updated in order to comply with any legal, regulatory, jurisprudential or technical developments. The User is invited to consult the latest version in force at each connection. However, the User’s Personal Data will always be processed in accordance with the Policy in force at the time of collection, unless an imperative legal requirement stipulates otherwise and applies retroactively.
